Research Updates for The Most Activist Supreme Court in History

By popular demand, this page updates some of the data in the book through the early years of the John Roberts era. In addition, some readers may be interested in my recent analysis of all federal statutes struck down by the Court since 1981.

No perfect source exists for identifying the Court's exercises of judicial review, but in the book, I relied primarily on the Congressional Research Service (CRS) report entitled, "The Constitution of the United States of America: Analysis and Interpretation." Through June 2008, the numbers reported below are drawn primarily from this report. For more recent cases, I have compiled the numbers myself, and where I am aware of judicial review decisions from before June 2008 that are not included in the CRS report, I have added those as well. I have also made a few small corrections to the data published in the book.
